Blueguru.com Provides Internet/World Wide Web Site Hosting, e-commerce and E-mail Services. Please read and understand our policies, as they are to protect the best interest of our customers as a whole.
BLUEGURU.COM's general policy is to act as a neutral provider of e-commerce, web hosting and email services. Blueguru.com reserves the right to suspend or cancel a customer's access to any or all services provided by Blueguru.com when Blueguru.com decides that the account has been inappropriately used. If you are unsure whether any contemplated use or action is permitted, please send mail to info@Blueguru.com and we will assist you.
Blueguru.com concept behind "unlimited traffic" and "unlimited storage" is to provide our customers with an unlimited amount of storage space and bandwidth for active web pages and cannot be used as a "storage space" for electronic files. Sites that fall under "electronic storage" are LARGE archives of images, compressed files, movies, or sound files. Blueguru.com allows up to 200 megs of archive storage and 5 megs of transfer per month, ex. movies, sound files (excluding real audio files), images, compressed files, etc. To ensure proper use, all HTML pages MUST be hyperlinked to files (.html,.jpg,.gif, etc.) stored on Blueguru.com server and vice versa. Cgi chat scripts are also not allowed and are considered an abuse of bandwidth. Any cgi scripts that consume large amounts of cpu usage or memory are also not allowed. The user will be asked to remove any script that abuses system resources.
Transmission, distribution, or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute. BLUEGURU.COM reserves the right to remove such illegal material from its server immediately. Blueguru.com expressly forbids anyone from using Blueguru.com servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, satanic material, or any other material which we deem to be objectionable. The designation of any materials as such described above is left entirely to the discretion of the Blueguru.com management.
BLUEGURU.COM does NOT allow adult oriented web sites. Because of the extremely large amount of bandwidth that is needed for these types of sites and our incredible offer of unlimited traffic, BLUEGURU.COM feels that these type of sites would compromise our speed. Blueguru.com does NOT host warez sites. This is, in most cases, illegal and very demanding on bandwidth. Web sites that are found to contain illegal (or pirated) software, or other copyrighted works including mp3's, or links to web sites that contain these types of material will be subject to IMMEDIATE account suspension and WILL BE REPORTED to the proper authorities.
Any site that is deemed as impairing the performance of our servers either by high disk utilization, high bandwidth usage, or high CPU usage will be entered into our "High Resource Customer" program. High Resource sites are sites that use an excessive amount of system resources such as bandwidth, storage or CPU utilization. It is Blueguru.com's sole discretion to decide which sites are "High Resource" sites. Please NOTE: Only the top 1% of our customers have ever qualified as a "High Resource Site." Sites who have been deemed as a "High Resource" site will be subject to the following:
- A $100 per month fee will be added to the user's current monthly fee, plus a charge of $30 for each additional megabyte over the permitted 5 gigs per month.
- Written authorization of billing must be faxed or mailed to Blueguru.com.
Blueguru.com strictly prohibits harassment, whether through language, frequency, or size of messages. Forging of header information is not permitted. Blueguru.com does not allow unsolicited mail. This includes "Spamming" and "Bulk Mail" sent to persons who have otherwise not requested to receive such mail. The reason for this is that not only is it generally frowned upon by the Internet community, but it also demands extra bandwidth to handle the effects of such mail.
Customers cannot sublease, subhost, or give away control of any portion of Blueguru.com resources. For customers who do wish to sublease web space, Blueguru.com offers a very competitive resale program. Violation of any of Blueguru.com Rules and Regulations could result in a warning, suspension, or possible account termination.
All accounts are set up upon receipt of full payment. Payment is due each anniversary period following the date the account was established. The customer is responsible for all money owed on the account from the time it was established to the time it is terminated. Requests for terminations must be submitted in writing to Blueguru.com.
For Credit Card Orders- Credit card orders will be set up within 24 hrs. Accounts will be automatically billed, on a monthly, quarterly or yearly basis, to the card number on file unless notified otherwise. In the event the credit card does not clear with the bank, the customer will be notified by e-mail. Past due accounts that are not brought current within 15 days of the e-mail notice are subject to suspension and possible account termination.
For Check or Money Order Orders- Check or money order orders will be set up within 24 hrs. upon receipt of payment. E-Mail notification will be sent 15 days prior to payment due date. Checks returned unpaid (NSF) will be assessed $15.00 service charge. Past due accounts that are not brought current within 15 days of the e-mail notice are subject to suspension and possible account termination.
All payment is in U.S. currency.
Blueguru.com reserves the right to cancel service at any time. All fees paid in advance of cancellation will be pro-rated and paid by BLUEGURU.Com, if Blueguru.com institutes its right of cancellation. If cancellation is caused by a customer's violation of these policies, then no refund will be disbursed unless the violation occurred within the 30-day trial period. In such a case, all monthly fees paid in advance of cancellation will be pro-rated and paid by Blueguru.com, with the exception of the setup fee which in such a case becomes non-refundable.
Customers can cancel service any time and be refunded any amount exceeding the pre-payment of the current month. Due to security concerns, all account cancellations must be done in writing via US mail or fax with a valid signature of the primary contact of the account, account name, reason for cancellation, and last 4 digits of credit card on file. If payment was made by check or bank transfer, the zip/postal code of the primary contact must also be included. Payment will be made by company check within 15 days of receipt of cancellation or credit card return. The account will be cancelled at the end of the current billing period, unless a date of cancellation is specified.
Blueguru.com will not be responsible for any damages your business may suffer. BLUEGURU.COM makes no warranties of any kind, expressed or implied for services we provide. Blueguru.com disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by BLUEGURU.COM and its employees. BLUEGURU.COM reserves the right to revise its policies at any time.
